Supreme Court pushes TN and Centre to talk, sets stage for Navodaya Vidyalayas expansion

In a key decision shaping education federalism, the Supreme Court of India on Monday directed the Tamil Nadu government to engage in joint consultations with the Union government on establishing Jawahar Navodaya Vidyalayas (JNVs) in the state, highlighting the need for cooperative federalism and student access to quality education.

A bench of Justices B V Nagarathna and R Mahadevan stressed that the issue should not become a language dispute, urging both governments to move beyond an adversarial approach and collaboratively address concerns. The top court underscored that the exercise was exploratory and meant to benefit rural students entitled to JNV admissions.

The court also asked authorities to ascertain the land required for setting up Navodaya Vidyalayas in each Tamil Nadu district, as part of the dialogue process before the matter returns for further judicial oversight.

During the hearing, senior advocate P Wilson, representing the Tamil Nadu government, reiterated objections to JNVs on the grounds that they follow a three-language formula under the National Education Policy—contrasting with the state’s statutory two-language policy of Tamil and English. The state also raised concerns about providing roughly 30 acres of land per district and bearing related costs.

However, the Supreme Court cautioned against framing the matter as one of language politics, observing that Tamil Nadu’s students should not be deprived of opportunities due to policy differences. “Don’t make it into a language issue. We are a federal society. You are part of the Republic. If you come one step forward, they will also come one step forward,” the court remarked, urging direct engagement rather than public posturing.

The high court order under challenge had earlier directed the state to permit JNV establishment, noting there was no imposition of Hindi and that Tamil was used in JNVs’ regional instruction. Tamil Nadu’s Special Leave Petition against this judgment questioned the compatibility of Navodaya Vidyalayas with its education policy.

This Supreme Court directive is widely seen as a reaffirmation of federal cooperation in education governance, emphasising that constitutional rights of students to choose quality educational institutions must be upheld without turning policy differences into entrenched conflicts.
