Motor accident claim by the kin of a software engineer killed in a road accident was enhanced by the Madras High Court from Rs. 30.7 lakh to Rs. 50.7 lakh.
The court has enhanced the compensation awarded by a motor accident claims tribunal by Rs. 20 lakh to the family of a software engineer who was killed in a road accident in 2005. The court held that the tribunal erred in calculating the compensation.
Parents of P Thenkathir, who died after being knocked down by a mini bus off Kodambakkam High Road, had appealed against the tribunal’s order.
Justice R Hemalatha, after going through the tribunal’s order passed in October 2013, noted that the deceased was aged 26 at the time of the accident and that the tribunal did not consider loss of future prospects. Citing Supreme Court guidelines, the court held that 40% should be added towards future prospects and after computing other factors, it enhanced the compensation.
The court directed the insurance company to deposit the compensation amount within four weeks.
